Who Pays — and How Much

California is an at-fault state, so the driver who caused the crash (and their insurer) is responsible for your damages. Under California Vehicle Code §16056, drivers must carry at least $30,000 / $60,000 in injury liability and $15,000 in property damage (as of January 1, 2025) — but serious injuries routinely cost far more than those minimums.

How Fault Is Determined in a California Crash

California uses a fault-based system: the driver who caused the crash must pay for the injured party’s losses. Fault comes down to negligence — when a driver fails to use the reasonable care every motorist owes others on the road. If police cited the at-fault driver, that ticket can establish negligence per se — the violation itself is evidence of careless driving. We dig into the police report, witness statements, and physical evidence to prove exactly who was responsible.

More than one party can share the blame — another driver, an employer (if the driver was working), or a vehicle owner who let an unlicensed or unfit driver use their car under California Vehicle Code §14606. Each at-fault party is responsible for its share, and we pursue every one of them.

How long do I have to file a car accident claim in California?
Most personal injury claims must be filed within two years of the crash under California Code of Civil Procedure §335.1. A few exceptions can change that deadline: if the injured person is a minor, the clock is paused until they turn 18 (giving them until their 20th birthday to file); if the at-fault driver leaves the state, the time they are gone may not count against you; and if you were left temporarily incapacitated, the deadline can be paused until you recover. Claims against a government entity — such as a city vehicle or a dangerously designed road — can have a deadline as short as six months, so it is important to talk to a lawyer quickly.
What if the other driver doesn’t have insurance?
You may still be covered. If you carry uninsured/underinsured motorist (UM/UIM) coverage, it can pay for your injuries when the at-fault driver has no insurance or not enough. We review every available policy to find the coverage that applies to your crash.
Can I still recover if the accident was partly my fault?
Yes. California follows pure comparative negligence, which means you can recover damages even if you were partly — or mostly — at fault. Your compensation is simply reduced by your percentage of fault. Don’t let an insurer talk you out of a valid claim.
